These Official Rules (“Rules”) govern all MotoMerica Inc. (“MotoMerica,” “we,” “us”) sweepstakes, merch-entry promotions, fixed-ticket competitions, and free member entries (each a “Promotion”) offered on motomerica.com and related channels.

1. Eligibility

Open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age (or the age of majority in their jurisdiction) at the time of entry. Void where prohibited. Employees of MotoMerica and their immediate family members are not eligible.

2. No Purchase Necessary

No purchase is necessary to enter or win a merch sweepstakes or to claim a member free entry. A purchase will not increase your chances of winning beyond the entries expressly awarded. Fixed-ticket competitions are separate capped draws with published ticket limits and odds based on tickets sold.

3. How to Enter

• Merch Sweepstakes: Purchase qualifying merchandise during the promotional period to receive the stated number of entries (including any active multiplier).
• Fixed Ticket Competitions: Purchase one or more tickets up to any per-person limits stated on the competition page.
• Member Free Entry: Registered members may claim one (1) complimentary entry per competition per calendar month, subject to verification and these Rules. Each raffle lasts one (1) month.*
• Alternate Method of Entry (AMOE): Where required by law, a free mail-in or online AMOE will be published on the applicable Promotion page.

4. Winner Selection & Notification

Winners are selected via a randomized, provably fair draw method (including live-streamed draws where advertised). Potential winners will be notified by email and may be required to complete an affidavit of eligibility, publicity release, and tax forms. Failure to respond within the stated timeframe may result in disqualification and selection of an alternate winner.

5. Prizes

Prize details, approximate retail value, and any cash alternatives are described on each Promotion page. Winners are responsible for taxes, title, registration, shipping coordination where applicable, and any other costs not expressly included. Prizes are non-transferable except at MotoMerica’s sole discretion.

6. Publicity

Except where prohibited, participation constitutes consent to MotoMerica’s use of winner name, likeness, and city/state for promotional purposes without further compensation.

7. General Conditions

MotoMerica reserves the right to cancel, suspend, or modify a Promotion if fraud, technical failure, or any other factor impairs integrity. Void entries and attempts to disrupt the site may result in disqualification and legal action. By entering, you release MotoMerica from claims arising from participation or prize acceptance, to the fullest extent permitted by law.

Quick answers about entries, membership, draws, and shipping.

How do I enter a giveaway?

Three ways: (1) shop merch for automatic entries, (2) buy fixed tickets on capped competitions, or (3) join as a free member and claim 1 free entry per competition per month.

How do I pay for merch or tickets?

MotoMerica uses Stripe for paid checkout. After you confirm your cart, you receive a CSV of your ticket numbers, then continue to Stripe when Payment Links are configured in js/payments.js. Free member entries never go through payment.

What is the ticket CSV?

When you check out, we generate one sequential 5–7 digit ticket number for each entry purchased (example: 340 entries → 340 ticket rows). Download and keep that file as your proof of entry.

How long does each raffle last?

Each competition runs for one calendar month.* See the Terms of Use and Official Rules.

Can members enter the same competition more than once for free?

No. Members receive one complimentary entry per competition per month. Additional entries come from merch or paid tickets.

Is membership really free?

Yes. Membership costs $0. Members get one complimentary entry per competition per month. You can still buy merch or tickets to stack more entries.

Do merch purchases increase my odds?

Merch awards the number of entries shown on each product (and any active multiplier). More entries improve your odds relative to other entrants, but every entry has an equal chance in the draw.

What are fixed ticket competitions?

These are capped pools with a maximum ticket count. Odds are transparent based on tickets sold. Draws are guaranteed on the advertised schedule once conditions are met.

How are winners chosen?

We use a randomized, provably fair process and often stream draws live. Past winners and recordings appear on the Winners page.

Where can I find car shows, donk races, and MC club events?

Open Event Calendar and browse All, or filter by shows, Import/JDM, Urban Car Culture, Racing, auctions, or Motorcycle Clubs & Rallies. The map is built for an even mix across scenes.

How long does shipping take?

Merch typically ships within 3–7 business days inside the U.S. Vehicle and high-value prizes are coordinated directly with winners after verification.

MotoMerica Inc. (“MotoMerica,” “we,” “us”) respects your privacy. This Policy explains how we collect, use, and share information when you use our website, membership, store, and promotions.

• Account data: name, email, password (hashed), membership status.
• Order & entry data: products purchased, ticket bundles, entry counts, payment confirmation references from our processors.
• Device & usage: IP address, browser type, pages viewed, and approximate location derived from IP.
• Communications: messages you send to support and marketing preferences.

2. How We Use Information

We use information to operate promotions, fulfill orders, verify eligibility, contact winners, prevent fraud, improve the site, and send transactional or (with consent) marketing messages. Member free-entry claims are logged in our CRM for integrity and support.

3. Sharing

We share data with payment processors, shipping partners, cloud hosting, analytics, and professional advisors as needed to run the business. We do not sell personal information. We may disclose information if required by law or to protect rights and safety.

4. Cookies

We use essential cookies for login, cart, and security, plus optional analytics cookies. You can control non-essential cookies through your browser settings.

5. Data Retention & Security

We retain account, order, and entry records as needed for legal, tax, and dispute purposes. We use administrative and technical safeguards appropriate to the sensitivity of the data; no method of transmission is 100% secure.

6. Your Choices

You may update account details, unsubscribe from marketing, or request access/deletion where applicable under state privacy laws (subject to exceptions for fraud prevention and legal holds). Contact us via the Support form.

Our services are not directed to children under 13, and we do not knowingly collect their personal information.

Terms of Service

Welcome to MotoMerica. By accessing or using our website, membership, store, or promotions, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the service.

1. Accounts

You are responsible for maintaining the confidentiality of your login and for activity under your account. Provide accurate information. We may suspend accounts that violate these Terms or Promotion rules.

2. Store & Payments

Product prices, entry awards, and availability may change. Orders are subject to acceptance. Payments are processed by third-party providers; we do not store full card numbers. Risk of loss for merchandise passes on delivery to the carrier.

3. Promotions

All sweepstakes, competitions, and member free entries are governed by the Official Rules and the specific Promotion page. In a conflict, the Official Rules control for that Promotion.

4. Content & IP

Site content, branding, product designs, and software are owned by MotoMerica or its licensors. You may not copy, scrape, or exploit the site for commercial purposes without written permission.

5. Acceptable Use

Do not attempt to hack, overload, or manipulate entries, draws, or pricing; do not use bots to create accounts or claim free entries; do not harass staff or other users.

6. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. Vehicle prizes may be subject to inspection, transport logistics, and local registration requirements.

7. Limitation of Liability

To the fullest extent permitted by law, MotoMerica’s total liability arising from the service or any Promotion will not exceed the greater of (a) amounts you paid us in the three months before the claim or (b) $100. We are not liable for indirect, incidental, or consequential damages.

8. Governing Law

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, unless mandatory consumer protections in your state provide otherwise.

9. Changes

We may update these Terms by posting a revised version with a new “Last updated” date. Continued use after changes constitutes acceptance.
